The Family Health Care Decisions Act: A Summary of Key Provisions

Swidler, Robert N.

The Family Health Care Decisions Act (FHCDA) establishes the authority of a patient’s family member or close friend to make medical treatment decisions for the patient in the event the patient lacks capacity to make such decisions personally, and did not previously make such decisions or appoint a health care agent. This article, written in 2010 shortly after enactment of the FHCDA, summarizes its key provisions.
