Surrogate Decision-Making for Incapable Adult Patients with Mental Disabilities: A Chart of Applicable Laws and Regulations

New York has different surrogate decision-making laws for patients with developmental disabilities; patients in or transferred from mental health facilities; and all of patients in hospitals, nursing homes and hospice. The article offers two charts to help hospitals and nursing homes identify the applicable decisionmaker and the applicable law for consent to treatment, or to withdraw or withhold life-sustaining treatment, for patients
with mental disabilities in different circumstances.
