Aliénation de l'affection – Bref traitement littéraire et jurisprudentiel / Alienation of affection – Brief literary and jurisprudential analysis

Affection is part of the reality of intimate associations. These are a particular type of associations between people who care for each other. Sometimes the affection disappears or is alienated, and the association thus impacted. In a society fundamentally based on individualism, such as the North American society, should falling in and out of love as a basis for the intimate association be connected with the possibility of a civil wrong, that of alienation of affection? Should it have consequences administered by the courts? Should the gender or age of the parties involved be taken into consideration? This article advances these questions. It incorporates a brief literary analysis of two great novels of quasi-urban morals. The novels are The Great Gatsby and Mysteries of Pittsburgh, which resonate with the author's existence in Manhattan and her more recent living and working arrangements in Pittsburgh. Then, through a historical analysis of the legal protection of this particular type of interference, the article propels the discussion on the value of legal protection.
