参照贸易法制定的投资规则是否可取?

传统双边投资协定(BITs)注重投资保护,即对外商投资准入后管理。投资协定
于近期补充了自由化规则与涉及关键人员、劳工权利与可持续发展的条款。此类
综合性投资协定已然成为特惠贸易协定(PTAs)的组成部分。该趋势源于北美自由贸易协定(NAFTA),在多边贸易协定(MAI)谈判中得到发展,并在过去的十年间成为特惠贸易协定(PTAs)的特征遍及世界。遗憾的是,PTAs 在投资领域的激增反而降低了 PTAs 的质量。多数协定包含范围较广的免责条款与界定模糊的保障条款,以致协定中关于外商投资准入后的监管价值受到质疑。
