The Repeal of New York’s Do Not Resuscitate Law: A Technical Clean-up Bill – And an Occasion for Reflection

This article describes New York's 1987 Do Not Resuscitate (DNR) Law; describes New York's 2010 Family Health Care Decisions Act, which largely but not entirely superseded the DNR Law; describes 2023 legislation that repeals remnants of the DNR Law; and identifies two key outstanding issues regarding resuscitation that still need to be addressed: (1) clarifying the legality of futility or "no-benefit" DNR orders without consent; and (2) extending the FHCDA to decisions by people with developmental disabilities.
